Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Inklined platform and services ("Service") operated by AI GTM Studio.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Definitions

  • "Content" means any text, images, or other material generated through or uploaded to the Service.
  • "User Content" means content you provide to the Service, including voice samples, writing samples, and topic preferences.
  • "Generated Content" means blogs, LinkedIn posts, and other written content created by the Service based on your User Content.
  • "Third-Party Services" means external services you connect to Inklined, including Fireflies, Fathom, LinkedIn, and WordPress.
  • "Subscription" means your paid access to the Service under one of our pricing plans.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access or use of your account.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. The Service

4.1 Service Description

Inklined is a content generation platform that helps consultants, coaches, and professionals create thought leadership content. The Service uses artificial intelligence to generate written content based on your inputs, preferences, and connected data sources.

4.2 Third-Party Integrations

The Service allows you to connect third-party services including:

  • Fireflies and Fathom for accessing your call transcripts
  • LinkedIn for publishing content
  • WordPress for publishing blog posts

Your use of these Third-Party Services is subject to their respective terms of service and privacy policies. Inklined accesses data from these services only with your explicit authorisation and in accordance with their API terms.

4.3 AI-Generated Content

The Service uses artificial intelligence to generate content. While we strive for high-quality output:

  • Generated Content may require your review and editing before publication
  • We do not guarantee the accuracy, completeness, or suitability of Generated Content
  • You are responsible for reviewing all content before publication
  • Generated Content should not be considered professional advice (legal, financial, medical, etc.)

5. Content Ownership and Rights

5.1 Your Content

You own all content you create using Inklined.

All Generated Content created through your use of the Service belongs to you. You retain full ownership and intellectual property rights to:

  • All blog posts generated by the Service
  • All LinkedIn posts generated by the Service
  • All other written content produced for you

We claim no ownership rights over your Generated Content. You are free to use, modify, publish, sell, or license your content in any way you choose.

5.2 Licence to Inklined

By using the Service, you grant Inklined a limited, non-exclusive licence to:

  • Process your User Content (writing samples, voice preferences, topics) to provide the Service
  • Store your content securely on our systems
  • Access your connected Third-Party Services data as authorised by you

This licence exists solely to enable us to provide the Service to you and terminates when you delete your account.

5.3 Data Export

You may export your content at any time. Upon account termination, you will have 30 days to export your content before it is deleted from our systems. To request a full data export, please email mark@beinklined.com

5.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity, or falsely claim affiliation with any person or entity
  • Generate spam, phishing content, or misleading information
  • Infringe upon the intellectual property rights of others
  • Attempt to gain unauthorised access to any part of the Service
  • Use the Service in any way that could damage, disable, or impair the Service
  • Use automated means to access the Service beyond the intended functionality
  • Resell, sublicence, or offer the Service to third parties as your own product

We reserve the right to suspend or terminate accounts that violate these terms.

7. Subscriptions and Payment

7.1 Subscription Plans

The Service is offered through subscription plans as described on our pricing page. Features and credit allocations vary by plan.

7.2 Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), who acts as our merchant of record. By subscribing, you also agree to Paddle's terms of service and privacy policy.

7.3 Billing

Subscriptions are billed in advance on a monthly or annual basis. Your subscription will automatically renew unless cancelled before the renewal date.

7.4 Credits

Your subscription includes a monthly allocation of credits ("ink"). Credits are used when generating content. Unused credits roll over for one month, after which they expire. Credits have no cash value and cannot be transferred.

7.5 Price Changes

We may change our prices with 30 days notice. Price changes will take effect at your next renewal date. Continued use of the Service after a price change constitutes acceptance of the new price.

9. Service Availability

9.1 Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend access for maintenance, updates, or circumstances beyond our control.

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes where practicable.

10. Limitation of Liability

10.1 Service Provided "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 Limitation

To the maximum extent permitted by law, Inklined shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

10.3 Cap on Liability

Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10.4 Exceptions

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Inklined and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Content you publish using the Service

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Inklined regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

13.5 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
